The scenario really hurts Luthor because it gives Horatio Caine a foot in the door on Luthor's plans. However, Luthor is pretty ridiculously smart in his own right. Also, Caine is a forensic analyst and crime scene investigator. He's not really trained in this sort of crime. I think this puts them at equal footing, and I would consider Luthor considerably smarter.

I don’t think it gives Horatio nearly enough to level the field here, especially if Luthor has someone already planted on the inside. Luthor is smart enough to outmaneuver and manipulate people outside of Horatio’s level.

Unironically, I think Luthor's reach goes far higher than Horatio's reach does. Chances are that Horatio would hire someone that would bend over to Luthor first before he does to Horatio, cause dude has an amount of money that's frankly hilarious. And if he could buy them, well, chances are he already did and set them there to be a part of his plan.
